1.In accordance with the provisions of Article 3 of the Act Governing Relations between the People of the Taiwan Area and the Mainland Area, the provisions of this Act pertaining to the people of the Mainland Area shall likewise apply to the people of the Mainland Area who reside outside the Mainland Area. Also, in accordance with the provisions of Article 7 of the Enforcement Rules for the Act Governing Relations between Peoples of the Taiwan Area and the Mainland Area, the phrase “People of the Mainland Area who reside outside the Mainland Area” as used in Article 3 of the Act shall include people who were born in foreign countries and hold passports issued by the Mainland Area, but exclude the following persons who have resided abroad for over four years and wh 1. have obtained citizenship of the country where they reside; or 2. have obtained permanent residency status of the country where they reside and hold valid passports issued by the R.O.C.
2.Currently, Taiwan has not yet opened its doors for the people of the Mainland Area to work in Taiwan.
3.Residents of Hong Kong and Macau refer to those with permanent residence status in Hong Kong or Macau and without British national (overseas) passport or travel licenses aside from Hong Kong and Macau passports; or those, although holding Portugal passports, who have obtained these in Macau prior to the end of Portuguese rule. During the period where these types of residents of Hong Kong or Macau are employed to work in the Taiwan region, they will be handled in accordance with the regulations for foreigners.
4.In addition, if the residents of Hong Kong or Macau from the previous paragraph have obtained the status of overseas Chinese prior to the end of British or Portuguese rule, respectively, or those whose spouses and children have met the requirements for obtaining Republic of China nationality, they can apply for employment permits from the Ministry in accordance with the provisions of “Management and Approval Regulations for Hong Kong and Macao Residents with Overseas Chinese I.D.”
