Those foreigners whose engaged artistic and entertainment performances are public performances shall submit documents proving the sites are in accordance with the provisions of Paragraph 2, Article 47 of the Criteria Standards. In addition, since the performance site doesn’t belong to the application unit, the letter of consent of the person in charge of the site must also be submitted.
1.If the foreigner is public performing entertainment performer, the performance site shall be in accordance with the provisions of Paragraph 2, Article 47 of the Criteria Standards as follows:
(1) Schools, social, educational and/or cultural organizations, parks, stadia (gymnasia), exhibition sites (exhibition halls), or other similar sites:
In principle, the previously mentioned “other similar sites” are identified in accordance with the information displayed from the performance site inquiries of the National Information System for Artistic and Cultural Activities Website:http://event.moc.gov.tw/mp.asp?mp=1
(2) International tourist hotels: refer to sites that included tourist hotel industries as a business registration item in the Company Establishment or Change Registration Form and that hold tourist hotel business licenses issued by the Tourism Bureau, Ministry of Transportation and Communications.
(3) Scenic, or tourist and recreation areas:
a. Scenic areas: refer to sites allocated by the competent authority jointly with the related departments in accordance with relevant laws and regulations to maintain the natural landscape and improve the recreation and tourism environment for the people. (Ministry of the Interior – Article 11 of the Enforcement Rules for the Regional Plan Act)
b. Tourist and recreation areas: refer to sites that are legally established through registration and that hold tourism, recreation, leisure, and other related licenses.
(4) Sites where the employers of publication enterprises, motion picture enterprises, wireless, cable, or satellite broadcasting and television enterprises employ foreigners to produce publications, films, or video with recorded programs, or broadcast and television programs: refer to sites that included motion picture enterprises or broadcast and television programs as a business registration item in the Company Establishment or Change Registration Form and that hold motion picture enterprise or broadcast and television program permits, such as the Chinese Culture and Movie Center, television studios, and radio stations.
(5) Sites where the employers of publication enterprises, motion picture enterprises, wireless, cable, or satellite broadcasting and television enterprises market and sell the entertainment performance works mentioned in the preceding subparagraph: such as movie theaters and television stations.
(6) Other sites approved or permitted by the competent authority to be dedicated to artistic or entertainment performances:
a. Includes art and cultural service industries as a business registration item in the Company Establishment, Change, or Business Registration Form.
b. Identified by the official letters or letters of consent of the central or local competent authorities, such as the documents of performance approval usage by the Ministry of Culture (Department of Cultural Affairs), competent authorities in charge of or manage the site, or competent authorities of the application unit.
2.In accordance with the application units, and workplace and site management units, whether documents proving the site is in accordance with the applied work usage shall be submitted for the different attributes are as shown in the attached table (加連結)
