For employers employing foreigners to engage in artistic and entertainment performances, the qualifications of employers shall be in accordance with one of the following provisions of Article 47 of the “Qualifications and Criteria Standards for Foreigners Undertaking the Jobs Specified under Subparagraphs 1 to 6, Paragraph 1, Article 46 of the Employment Service Act”:
1.Schools, or public organizations in the social, educational and/or cultural sector.
2.International tourist hotels: Those that included tourist hotel industries as a business registration item in the Company Establishment or Change Registration Form and that hold tourist hotel business licenses issued by the Tourism Bureau, Ministry of Transportation and Communications or by the county or city government.
3.Tourism and recreation enterprises: Those that included tourism and recreation enterprises as a business registration item in the Company Establishment or Change Registration Form and that hold tourism and recreation enterprise licenses issued by the Tourism Bureau, Ministry of Transportation and Communications or by the county or city government.
4.Show business enterprises: Those that included show business enterprises as a business registration item in the Company Establishment, Change, or Business Registration Form.
5.Cultural and educational entities: Those legally-established registered associations whose organization’s established constitution states the promotion or holding of artistic, cultural, educational, and other related matters.
6.Performing, academic and cultural, or artistic groups: (1) Performing groups refer to registered groups by local authorities in accordance with the provisions of self-governance articles of local authorities and engages in music, drama, dance, mixed art, and other performances and various performance events with non-profit purposes. (2) Academic and cultural or artistic groups: Groups whose main functions are to promote educational, cultural, or artistic events and enhance academic research. (Ministry of the Interior – Regulations for Registration of Social Entities)
7.Publication enterprises: Those that included publication enterprises as a business registration item in the Company Establishment, Change, or Business Registration Form.
8.Motion picture enterprises: Those that included motion picture enterprises as a business registration item in the Company Establishment or Change Registration Form.
9.Wireless, cable or satellite broadcasting and television enterprises: The business item of the Company Establishment or Change Registration Form attached by the employer must have stated business items such as broadcasting enterprises, television enterprises, cable television system operators, cable television program broadcasting system enterprises, direct satellite broadcasting and television service operators, and satellite broadcasting and television program suppliers, and the employer shall also submit a photocopy of the permit issued by the central governing authority (i.e. the National Communications Commission).
10.Government agency. or administrative corporation.
11.Foreign consulates or institutions in Taiwan or international organizations in Taiwan.
