Documents required when applying for a work permit for a foreign professional (for H category short-term cram school skills-based teachers)

1 Original review fee receipt (V) (V) 1. Each application costs NT$500.
2. After filling in or registering payment receipt data a physical copy of the receipt does not have to be attached. However, depending on the situation in individual cases the Ministry of Labor can still ask employers to attach a physical copy of the receipt (in accordance with Ministry of Labor announcement Lautungfashihtzu No. 1110523178 issued on November 25, 2022).

4 Photocopy of employed foreign worker’s passports or Alien Resident Certificate (ARC) The documents must be valid on the day employment commences.
5 Photocopy of one of the following documents indicating a hired foreign worker meets one of the eligibility criteria:
(1) Participated in the manufacture of a product that won an important international award,
(2) Four years or more work experience in the foreign digital content industry and two years or more teaching experience at an international teaching institution.
(3) Any other internationally renowned professional, specially approved after consultations between the Ministry of Labor and central competent authority for the target industry.
   
6 Original copy of certified documentation indicating a foreign worker passed a medical examination at a central health and welfare authority approved medical facility within the three months prior to the date of application.  
7 A certified national police record, issued by the passport issuing country within the past six months that indicates the hired foreign worker has no criminal record for sexual assault, sexual harassment, sexual exploitation, sexual bullying or violating the rights of children or youth.   This is not required when a foreign worker was previously issued with an employment permit to engage in short term cram school skills-based teaching or foreign language teaching work.
8 Photocopy or copy of the employment contract. The name, nationality, job title or work content (enough to confirm the category of work in which the foreign worker is engaged), salary and period of employment of the hired foreign worker must be clearly stated and signed by both parties.
9 Photocopy of the hiring entity responsible person’s Republic of China (Taiwan) National ID, passport or ARC.  

1. The responsible person should be the same individual listed on the company registration form.
2. Documentation must be valid on the day of application.

10 Photocopy of the hiring entity’s company registration certificate.   The company certified registration or updated registration documentation must be valid.
11 Photocopy of the cram school registration certificate.   Certified cram school registration must be valid and the school established by the employer
12 Photocopy of a cooperative contract signed with an international teaching institution. 1. The employment period applied for cannot be longer than the valid period of the contract.
2. This provision does not apply if an individual is determined to have made a substantive contribution to the cultivation of domestic talent after consultations between the Ministry of Labor and central competent authority for the target industry.
13 Photocopy of the hired foreign worker’s payroll withholding statement for the past year (including a photocopy of a tax withheld at source statement).   (V) Although this may be waived, when deemed necessary and depending on the situation, the Ministry of Labor can still ask employers to attach a physical copy (in accordance with Ministry of Labor announcement Lautungfashihtzu No. 1110523178 issued on November 25, 2022).
14 Photocopy of the original employment permit.   If the employment permit letter number is provided this is waived (in accordance with Ministry of Labor announcement Lautungfashihtzu No. 1110523178 issued on November 25, 2022).
15 When a hired foreign worker is a minor, his or her legal representative is required to agree to the employment documents, as well as provide a photocopy of the legal representative’s passport.    

※Documents required for the termination of an employment relationship (dismissal): 1. Application form. 2. Photocopy of the employment permit letter (this is not required if the employment permit letter number is provided). 3. Photocopy of ARC. 4. Employment relationship termination certified documentation.

※Applications for the reissue of an employment permit require the submission of the following documentation: 1. Application form (tick the “reissue” option in the application form, and provide the “work permit” letter number that you want to be reissued. 2. An affidavit explaining the reason for the reissue application.

※If appended documents are in a language other than English, a translated Chinese language version must be provided.

※When it is announced that documentsfrom certain designated countries need to be submitted to a Republic of China overseas mission for verification, please submit the documents for verification and provide photocopies for review by the Ministry of Labor (when necessary and depending on case-by-case situations, the ministry may ask an employer to provide original copies).
